Terms of
Service.
The terms governing use of this website and engagement of DGR REMODELING, LLC for construction and remodeling services.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a binding agreement between you and DGR REMODELING, LLC ("we," "us," or "our"), located at 2849 Sharon Copley Rd, Medina, Ohio 44256, United States. By accessing this website or engaging our services, you agree to these Terms and to our Privacy Policy.
If you do not agree to these Terms, do not use this website. Specific projects are governed by separate written contracts; where a signed construction contract conflicts with these Terms, the contract controls for that project.
2. Our Services
We provide residential construction and remodeling services, including (without limitation) single-family and multifamily construction as general contractor; for-sale, merchant, and speculative building; additions, alterations, and renovations; porch and sunroom construction; fire and flood restoration; handyman services; and residential construction management.
Content on this website — service descriptions, process information, and project examples — is provided for general informational purposes and does not constitute a quote, offer, or commitment to perform work.
3. Website Use
- You must be at least 18 years old to submit project information or request estimates through this website.
- You agree to provide accurate information in forms and correspondence.
- You will not misuse this website — including attempting unauthorized access, disrupting operations, or submitting unlawful, defamatory, or deceptive material.
- Submitting an inquiry does not create a contract. An estimate, proposal, or engagement arises only through a written document accepted by both parties.
4. Estimates and Proposals
- Estimates are based on the scope of work described at the time and on conditions observable during walkthrough.
- Estimates are valid for the period stated in the proposal and may be revised if scope, site conditions, material pricing, or code requirements change.
- Unless stated otherwise, estimates are not fixed-price bids; final pricing is established by the written contract.
- Allowances, where used, are identified in the proposal; actual selections above or below allowance amounts adjust the contract price.
5. Contracts and Change Orders
- Construction work is performed under a written contract specifying scope, price, schedule, and payment terms.
- Change orders: changes to scope, materials, or schedule after contract signing are documented in written change orders and may affect price and completion dates.
- Verbal requests to change the work will be confirmed in writing; work on changed scope proceeds after change-order acceptance.
- Delays caused by weather, permitting, inspections, material availability, owner decisions, or unforeseen conditions may extend schedules without penalty.
6. Site Access and Owner Responsibilities
- Owners must provide reasonable access to the work site, utilities (water, electric), and parking or staging space as needed.
- Occupied remodels: owners are responsible for removing or securing personal property, pets, and valuables from work areas before work begins.
- Owners must disclose known site conditions — including hazardous materials, easements, septic or well systems, and prior unpermitted work — to the best of their knowledge.
- Owner-supplied materials must arrive per the project schedule; delays in owner-supplied items may affect the schedule and price.
7. Concealed and Unforeseen Conditions
- Remodeling and renovation work can reveal concealed conditions — rot, mold, structural deficiencies, outdated wiring or plumbing, asbestos, or prior code violations.
- Concealed conditions discovered during demolition or construction will be reported promptly; remediation beyond the stated scope is handled by change order.
- We may suspend work in affected areas until concealed conditions are addressed.
8. Permits and Compliance
- We obtain required building permits for work within our scope unless the contract states otherwise.
- Work is performed in accordance with applicable building codes; inspections are scheduled and documented as required.
- Owners must not direct work that would violate codes, permits, or safety requirements.
9. Payment Terms
- Payment schedules — deposits, progress payments, and final payment — are established in the written contract.
- Invoices are due per contract terms; late payments may accrue interest or result in work suspension.
- Final payment is due upon substantial completion and delivery of the punch list; retainage, if any, is per contract.
- We reserve all lien rights available under applicable law for unpaid work.
10. Warranties
- Workmanship is warranted as stated in the written contract for the specified period from substantial completion.
- Manufacturer warranties on materials and products pass through to the owner; we do not extend manufacturer terms.
- Warranty claims require written notice describing the defect; we will inspect and remedy covered items within a reasonable period.
- Warranties do not cover damage caused by misuse, neglect, owner alterations, third-party work, or normal wear and settlement.
11. Intellectual Property
All content on this website — text, graphics, layout, photography, and design — is owned by or licensed to DGR REMODELING, LLC and protected by intellectual-property law. You may view and print pages for personal, non-commercial use only; any other reproduction, distribution, or derivative use requires our prior written consent. 13. Limitation of Liability
To the maximum extent permitted by law, DGR REMODELING, LLC and its members, managers, employees, and agents shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of this website. Liability for project-related claims is governed by the applicable written contract. Our total liability for any claim related to this website shall not exceed the amount you paid us for the relevant service, if any.
14. General Provisions
- Governing law: These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.
- Changes: We may update these Terms at any time; changes take effect upon posting. Continued use of the website constitutes acceptance.
- Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
- No waiver: Failure to enforce a provision does not waive our right to enforce it later.
- Entire agreement: These Terms, together with the Privacy Policy and any written construction contracts, constitute the entire agreement between you and us regarding this website and our services.
